Description

RA 8749 – Clean Air Act is an Act provides for the creation of a national program of air pollution management focusing primarily on pollution prevention; for the promotion of mass media communication in order to create social awareness and active participation in air quality planning and monitoring.

Applying for a Permit to Operate (PTO) from the Department of Environment and Natural Resources (DENR) in the Philippines involves a specific process for businesses that engage in activities causing air pollution. The PTO requirement is based on Republic Act 8749, commonly known as The Clean Air Act of 1999.

Here’s a brief description of the application process, the types of businesses requiring a PTO, the estimated duration of the process, and the potential fines for non-compliance:
Identifying the Need for a PTO: The DENR requires companies whose business activities involve equipment that emits air pollutants to obtain a PTO. The following types of equipment are typically associated with significant air emissions:

  • Internal Combustion Engines, such as Generator Sets and Gas Turbines: Generator sets are defined as equipment that converts heat capacity into mechanical energy and then into electrical energy.
  • External Combustion Engines, such as Boilers and Fuel-Burning Steel Mill Furnaces: Boilers are enclosed vessels that heat fluids like water to produce steam or vaporized forms of liquids.
  • Cement Kilns and Other Sources: This category includes various sources like waste-to-energy technology and pyrolysis, apart from cement kilns.

Scope of PTO Requirement: According to DENR Administrative Order 2000-81, all sources of air pollution covered by the implementing rules and regulations must have a valid PTO. If your company operates any of the equipment listed above, it falls under the purview of the PTO requirement.

Application Process: To apply for a PTO from the DENR, businesses must follow these general steps:

  • Prepare Required Documents: Compile the necessary documents, which may include business registration details, environmental compliance certificate, emission test results, company profile, and other supporting information as specified by the DENR.
  • Complete Application Form: Fill out the application form provided by the DENR accurately and comprehensively.
  • Submit Application: Submit the completed application form and all required documents to the designated DENR office or online portal, as specified by the department.
  • Payment of Fees: Pay the application processing fees, which may vary depending on the nature and scale of the business.
  • Evaluation and Inspection: DENR representatives will evaluate the application and may conduct inspections to verify compliance with air pollution control measures.
  • Approval and Issuance: If the application meets the necessary requirements and compliance standards, the DENR will grant the PTO and issue the permit accordingly.

Processing Time: The duration for processing a PTO application can vary depending on factors such as the completeness of the submitted documents, the complexity of the business operations, and the workload of the DENR office. Typically, the process may take several weeks to a few months. It is advisable to contact the DENR office directly, refer to their official website for specific information regarding current processing times, or contact us for assistance.

Fines for Non-Compliance: Failure to obtain a valid PTO as required by DENR regulations can result in significant penalties and fines. The specific fines may vary depending on the severity and duration of non-compliance, but they can be substantial. It is crucial for businesses to adhere to the PTO requirement to avoid legal and financial consequences.

Note: It is essential to consult with the DENR or seek professional advice to ensure accurate and up-to-date information regarding the application process, specific requirements, and associated fines for non-compliance with PTO regulations.
